Terms of Service

1. Definitions

• Platform — the website and services available at aigeodc.com.
• Service — the environmental intelligence dashboard, data centre tracking, comparison tools, alerts, and reports provided through the Platform.
• Subscription Plan — one of Free, Pro, Team, or Enterprise, as described in section 5.
• Environmental Data — publicly sourced grid carbon intensity, air quality measurements, weather data, and derived environmental scores.
• Portfolio — a user's tracked set of data centres within the Platform.

2. Acceptance

By creating an account or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

3. Registration

You must be at least 18 years old to register, or at least 16 with verifiable parental consent. Each person or company may hold one account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

4. Service Description

AIGeoDC provides an environmental intelligence platform that aggregates public data to help organisations:

• Monitor grid carbon intensity, air quality, and weather conditions at data centre locations
• Track environmental scores across their data centre portfolio
• Compare data centres side by side
• Set alerts for environmental threshold breaches
• Generate environmental reports (Pro and above)

All environmental data is sourced from public APIs and may contain inaccuracies. Scores are informational and should not be the sole basis for compliance, investment, or regulatory decisions.

5. Subscription Plans

• Free — basic access, 30-day history, up to 5 tracked data centres.
• Pro (€29/month) — 1-year history, personal alerts, PDF exports, priority email support.
• Team (€99/month) — everything in Pro, plus 5 seats, shared workspaces, and side-by-side comparison.
• Enterprise — custom pricing, unlimited seats, 5-year history, custom SLAs.
• Subscriptions auto-renew monthly. You may cancel at any time; access continues until the end of the current billing period.
• AIGeoDC is subscription-based. There is no credits or token system.

6. Payments

All prices are in EUR. Подвиг ЕООД is not registered for VAT under Art. 97a of the Bulgarian VAT Act; no VAT is charged. Payments are processed by Stripe. Bank transfers are accepted to IBAN BG73UNCR70001528266445 (UniCredit Bulbank). Invoices are issued electronically and retained for 10 years per Bulgarian accounting law.

7. Right of Withdrawal

If you are a consumer in the EU, you have 14 days from the date of purchase to withdraw and receive a full refund, provided you have not used the paid features during that period. To withdraw, email support@podvik.com with your account email and the word "withdraw". Refunds are processed within 14 days to the original payment method.

8. Prohibited Use

• Scraping or automated extraction of data beyond documented API limits
• Reselling data or Platform access without written permission from Подвиг ЕООД
• Circumventing subscription plan limits or rate limits
• Using the Platform to generate misleading environmental claims (greenwashing)
• Attempting to reverse-engineer scoring algorithms
• Creating multiple accounts to bypass plan limits

9. Data Accuracy Disclaimer

• Environmental data is sourced from public third-party APIs (ENTSO-E, OpenAQ, Open-Meteo, WRI Aqueduct).
• Scores are calculated models, not certified measurements.
• Data may have delays, gaps, or inaccuracies inherent to the source.
• The Platform is not a substitute for professional environmental assessment or certification.
• "Not disclosed" means data is not publicly available for that facility — it does not imply the data does not exist.

10. Intellectual Property

The Platform's code, design, brand, and documentation are owned by Подвиг ЕООД. Environmental data is sourced from public APIs — we make no intellectual property claim on raw data from those sources. You may not reproduce, redistribute, or create derivative works from the Platform without written permission.

11. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Подвиг ЕООД's total liability is limited to the fees you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, data loss, or business interruption.

12. Termination

Either party may terminate at any time. You may delete your account from the settings page. We may suspend or terminate accounts that violate these Terms, with notice where practicable. Upon termination, your data is deleted within 30 days, except where retention is required by law.

13. Dispute Resolution

Please contact support@podvik.com first — most issues can be resolved informally. Consumers in the EU may also use the European Online Dispute Resolution platform (ec.europa.eu/odr). Formal complaints may be filed with the Commission for Consumer Protection (КЗП). Any disputes not resolved informally are subject to the jurisdiction of the courts of Varna, Bulgaria.

14. Governing Law

These Terms are governed by the laws of the Republic of Bulgaria and applicable European Union law.
